Privacy Policy

1. Information on the processing of personal data

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), we inform that the User’s personal data may be processed both by the Service Administrator and by the User themselves – depending on the type of data and the purpose of its processing.

2. Personal data controller

The controller of the User’s personal data, in particular identification, contact, billing, and account-related data in the Service, is:

The controller of the personal data entered into the Application by the User, in particular data of the User’s customers, accommodation guests, reservations, telephone numbers and guests’ e-mail addresses, is the User.

dpTechnologies s.c. processes the personal data of the User’s customers and guests solely as a processor within the meaning of Article 28 GDPR, to the extent necessary for the provision of the Service.

3. Entrustment of data processing (Article 28 GDPR)

To the extent that dpTechnologies s.c. processes the personal data of the User’s customers and guests, such processing is carried out on the basis of a personal data processing agreement within the meaning of Article 28 GDPR.

The entrustment includes in particular:

  • storage of data,
  • ensuring system availability,
  • technical support and troubleshooting,
  • performing backups,
  • ensuring data security.

Data are processed solely on the documented instructions of the User, with the application of appropriate technical and organisational measures.

The User, as the controller of the personal data of customers and guests, is obliged to fulfil towards them the information obligations arising from Articles 13 and 14 GDPR.

4. Purposes of data processing

Processing by the Administrator (dpTechnologies s.c.) includes:

  • provision of the Service and the Application and operation of the User’s account,
  • fulfilment of legal obligations (in particular tax and accounting obligations),
  • ensuring system security,
  • handling requests and communication with the User,
  • establishment, pursuit or defence of claims,
  • conducting marketing activities solely on the basis of separate consent.

Processing by the User includes:

  • management of reservations and guest data,
  • contacting customers,
  • processing personal data in compliance with the GDPR and other applicable regulations.

Provision of personal data is voluntary; however, it is necessary for the conclusion and performance of the agreement for the provision of services by electronic means. Failure to provide data may prevent account registration, use of the Service, or use of selected Application functionalities.

5. Legal basis for processing

The processing of personal data by the Administrator is based on:

  • Article 6(1)(b) GDPR – performance of the agreement for the provision of services by electronic means,
  • Article 6(1)(c) GDPR – legal obligations,
  • Article 6(1)(f) GDPR – legitimate interest of the Administrator (security, handling requests, claims),
  • Article 6(1)(a) GDPR – the User’s consent (e.g., marketing).

6. Consent to marketing contact

Marketing contact (e-mail, telephone, SMS) is carried out solely on the basis of separate, voluntary consent of the User, granted in accordance with the provisions of the Electronic Communications Law (PKE).

Marketing consent:

  • is not a condition for using the Service,
  • does not result from acceptance of the Terms and Conditions or the Privacy Policy itself,
  • may be withdrawn at any time.

7. Recipients of personal data

Personal data may be disclosed to entities cooperating with the Administrator, in particular:

  • IT service providers, hosting and server infrastructure providers,
  • accounting and bookkeeping service providers,
  • payment operators,
  • public authorities – to the extent required by law.

The Administrator does not transfer personal data outside the European Economic Area (EEA). Data are processed exclusively on infrastructure located within the EEA.

8. Data retention period

  • User data – for the duration of the agreement and up to 6 years after its termination,
  • billing data – in accordance with tax regulations,
  • marketing data – until consent is withdrawn,
  • customer and guest data – in accordance with the decisions of the User as the controller of such data.

9. User rights

The User has the right to:

  • access their data,
  • rectify data,
  • erase data,
  • restrict processing,
  • data portability,
  • object to processing,
  • withdraw consent at any time.

10. Profiling and automated decision-making

The Administrator does not make decisions concerning Users based solely on automated processing, which would produce legal effects or similarly significantly affect them.

11. Complaint to the supervisory authority

The User has the right to lodge a complaint with the President of the Personal Data Protection Office (UODO):

12. Integration with Google / Gmail API

The Application enables:

Data obtained via Google API are used exclusively for the purpose of providing the e-mail sending functionality from within the Application.

The content of e-mail messages and recipients’ address data:

  • are not used for advertising or profiling purposes,
  • are not sold or shared with third parties,
  • are not used to build user profiles.

The User may revoke the Application’s access to their Google account at any time in the security settings of their Google account.

The Administrator does not use data obtained via Google API to create, train, or improve artificial intelligence or machine learning models.

The Application operates in compliance with the Google API Services User Data Policy, including the Limited Use requirements.

13. Apple App Store and Google Play

With regard to subscriptions processed via Apple App Store and Google Play, Apple and Google act as separate controllers of personal data, in accordance with their own terms and privacy policies.
